L&#8217;organisme demande le retrait du projet de loi et soutient les demandes r\u00e9p\u00e9t\u00e9es d&#8217;octroyer un mandat au Bureau d&#8217;audiences publiques sur l&#8217;environnement (BAPE) concernant la question de la gestion des mati\u00e8res dangereuses.\u00a0<\/span><\/p><p><span style=\"font-weight: 400;\">Le CQDE s\u2019inqui\u00e8te des cons\u00e9quences d\u00e9mocratiques et environnementales qui d\u00e9couleront de ce\u00a0 projet de loi. <\/span><b>L\u2019adoption d\u2019une loi sp\u00e9ciale pour contourner la volont\u00e9 des municipalit\u00e9s et permettre la destruction d\u2019un milieu naturel de haute valeur \u00e9cologique constitue une m\u00e9thode draconienne qui va \u00e0 l\u2019encontre des principes d\u00e9mocratiques et des engagements du Qu\u00e9bec envers la protection de la biodiversit\u00e9 et de l\u2019environnement.<\/b><span style=\"font-weight: 400;\"> Cette fa\u00e7on de proc\u00e9der t\u00e9moigne d\u2019un manque de consid\u00e9ration pour l\u2019opinion de la population et l\u2019autonomie des municipalit\u00e9s. Le projet de loi permet aussi au gouvernement de mettre de c\u00f4t\u00e9 certaines de ses propres normes environnementales, en plus de constituer un pied de nez \u00e0 la reconnaissance de l\u2019autonomie municipale, pourtant mise de l\u2019avant au m\u00eame moment dans le projet de loi 81.<\/span><\/p><h5><em><span style=\"font-weight: 400;\">\u00ab L\u2019environnement est encore la grande sacrifi\u00e9e de d\u00e9cisions politiques et \u00e9conomiques sans vision. Or quand nous sacrifions l&#8217;environnement, c&#8217;est notre qualit\u00e9 de vie, notre sant\u00e9 et notre avenir m\u00eame qui sont sacrifi\u00e9s. En pleine crise climatique et de la biodiversit\u00e9, c\u2019est irresponsable \u00bb, d\u00e9nonce Genevi\u00e8ve Paul, directrice g\u00e9n\u00e9rale du CQDE.<\/span><\/em><\/h5><p><span style=\"font-weight: 400;\">Qui plus est, le projet de loi exclut la plupart des possibilit\u00e9s de recours \u00e0 l\u2019encontre des pouvoirs qu\u2019il octroie au gouvernement. Il emp\u00eache \u00e9galement de poursuivre Stablex avant le 15 avril 2025 si l\u2019entreprise obtient l\u2019autorisation d\u2019aller de l\u2019avant avec son projet, sauf en cas de faute lourde ou intentionnelle. \u00c0 cette date, les destructions caus\u00e9es par les travaux pr\u00e9alables seraient ainsi d\u00e9j\u00e0 effectu\u00e9es. Le CQDE est tr\u00e8s pr\u00e9occup\u00e9 par ces dispositions qui retirent la possibilit\u00e9 pour les tribunaux de v\u00e9rifier la l\u00e9galit\u00e9 des d\u00e9cisions que prendra le gouvernement en vertu de ce projet de loi et des actes qui seront pos\u00e9s par Stablex.\u00a0<\/span><\/p><p><span style=\"font-weight: 400;\">Avec ce projet de loi, le gouvernement ignore les recommandations du BAPE et les pr\u00e9occupations de la population. Il choisit de d\u00e9truire un milieu naturel que la municipalit\u00e9 de Blainville, appuy\u00e9e par la Communaut\u00e9 m\u00e9tropolitaine de Montr\u00e9al, tente de prot\u00e9ger, affaiblissant ainsi le r\u00f4le de protection de l\u2019environnement de celles-ci. Il donne la permission \u00e0 Stablex de ne pas respecter les normes municipales qui visent la protection de l\u2019environnement, dont notamment le R\u00e8glement de contr\u00f4le int\u00e9rimaire de la Communaut\u00e9 m\u00e9tropolitaine de Montr\u00e9al, r\u00e9cemment adopt\u00e9.\u00a0<\/span><\/p><h5><em><span style=\"font-weight: 400;\">\u00ab \u00c0 quoi bon d\u00e9ployer des processus d\u00e9mocratiques, consulter le BAPE, mobiliser les municipalit\u00e9s et adopter des r\u00e8glements si le gouvernement contourne les lois quand les r\u00e9ponses ne lui conviennent pas? \u00bb, conclut Genevi\u00e8ve Paul.<\/span><\/em><\/h5><p><span style=\"font-weight: 400;\">Pour toutes ces raisons, le CQDE demande que ce projet de loi soit retir\u00e9 et que la question de la gestion des mati\u00e8res dangereuses au Qu\u00e9bec soit analys\u00e9e rapidement par le <\/span><span style=\"font-weight: 400;\">BAPE.<\/span><\/p><p style=\"text-align: center;\"><span style=\"font-weight: 400;\">-30 &#8211; <\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t","protected":false},"excerpt":{"rendered":"<p>Montr\u00e9al, February 28, 2025 &#8211; The Centre qu\u00e9b\u00e9cois du droit de l\u2019environnement (CQDE) is extremely concerned about Bill 93, An Act respecting, in particular, the transfer of ownership of an immovable of Ville de Blainville, tabled this past week at the National Assembly.
