{"id":16336,"date":"2024-10-21T17:39:22","date_gmt":"2024-10-21T22:39:22","guid":{"rendered":"https:\/\/cqde.org\/news\/victory-for-the-mitchikanibikok-inik-first-nation-quebec-must-consult-on-existing-mining-claims-and-before-allowing-new-claims\/"},"modified":"2025-04-16T12:35:04","modified_gmt":"2025-04-16T17:35:04","slug":"victory-for-the-mitchikanibikok-inik-first-nation-quebec-must-consult-on-existing-mining-claims-and-before-allowing-new-claims","status":"publish","type":"post","link":"https:\/\/cqde.org\/en\/news\/energy-and-natural-resources\/victory-for-the-mitchikanibikok-inik-first-nation-quebec-must-consult-on-existing-mining-claims-and-before-allowing-new-claims\/","title":{"rendered":"Victory for the Mitchikanibikok Inik First Nation: Quebec Must Consult on Existing Mining Claims, and Before Allowing New Claims"},"content":{"rendered":"<p><b>Montreal\/Traditional Territories of the Kaniwn\u2019keh\u00e1 and Haudenosaunee Peoples, October 21,\u00a0 2024<\/b><span style=\"font-weight: 400;\"> &#8211; In a recent ruling, the Superior Court of Qu\u00e9bec recognized that the Qu\u00e9bec government failed for decades in its constitutional duty to consult the Mitchikanibikok Inik First Nation ( also known as the Algonquins of Barriere Lake) when mining claims were granted on its territory, and that it must now consult and as appropriate accommodate Mitchikanibikok Inik First Nation on existing and new claims.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Represented by lawyers from the <\/span><i><span style=\"font-weight: 400;\">Centre qu\u00e9b\u00e9cois du droit de l\u2019environnement (CQDE)<\/span><\/i><span style=\"font-weight: 400;\"> and Ecojustice, the Mitchikanibikok Inik First Nation achieved its goal of confirming that it must be consulted before mining claims are granted and before exploration activities are undertaken on its territory where Aboriginal rights and title are asserted<\/span><\/p>\n<p><span style=\"font-weight: 400;\">This victory adds to those of other Indigenous communities that have challenged \u201cfree entry\u201d mining regimes in other provinces: the case of the Ross River Dena Council in Yukon and the case of the Gitxaala and Ehattesaht First Nations in British Columbia. This victory also paves the way for other Indigenous communities in Qu\u00e9bec.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cThe Court recognized what we have always said: the Mitchikanibikok Inik have never given up our rights and sovereignty, and Quebec must stop allowing claims and impacting our territory without asking us first. We will never accept mining that puts our rights and our land at risk. We call on Quebec to obey the Court\u2019s judgment and put a halt to all mining claims and exploration on our territory immediately.\u201d\u00a0 &#8211; <\/span><span style=\"font-weight: 400;\">Chief Casey Ratt, Mitchikanibikok Inik\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cWith this decision, the court sends a clear message: free-entry mining which fails to uphold the duty to consult and accommodate is unconstitutional.
