{"id":16713,"date":"2023-10-05T14:53:09","date_gmt":"2023-10-05T19:53:09","guid":{"rendered":"https:\/\/cqde.org\/news\/the-cqde-calls-on-the-minister-of-the-environment-to-recommend-a-bape-hearing-in-the-northvolt-case\/"},"modified":"2025-04-16T13:50:35","modified_gmt":"2025-04-16T18:50:35","slug":"the-cqde-calls-on-the-minister-of-the-environment-to-recommend-a-bape-hearing-in-the-northvolt-case","status":"publish","type":"post","link":"https:\/\/cqde.org\/en\/news\/public-participation\/the-cqde-calls-on-the-minister-of-the-environment-to-recommend-a-bape-hearing-in-the-northvolt-case\/","title":{"rendered":"The CQDE calls on the Minister of the Environment to recommend a BAPE  hearing in the Northvolt case"},"content":{"rendered":"<p><strong>Montreal, October 5, 2023 &#8211;<\/strong> In view of the numerous public concerns and the risk of major<br \/>\nenvironmental issues surrounding the multinational Northvolt&#8217;s project to build a battery<br \/>\nplant in the Mont\u00e9r\u00e9gie region, the Centre qu\u00e9b\u00e9cois du droit de l&#8217;environnement (Quebec<br \/>\nenvironment law centre, or CQDE) is encouraging the Minister of the Environment to<br \/>\nrecommend that an environmental impact assessment and review procedure be initiated,<br \/>\nincluding hearings before the Bureau d&#8217;audiences publiques sur l&#8217;environnement (office of<br \/>\npublic hearings on the environment, or BAPE).<\/p>\n<p>The CQDE points out that the government may, on the recommendation of the Minister of<br \/>\nthe Environment, make a project subject to a BAPE assessment. Even when a project is not<br \/>\nnecessarily subject to such a review, it may be rendered so by government decision, under<br \/>\ncertain circumstances. It&#8217;s clear that these conditions are met with Northvolt: the potential<br \/>\nenvironmental stakes are extremely high; the project will entail a new type of activity or a<br \/>\nnew technology in Quebec; and public concerns justify it. So why dispense with a thorough<br \/>\nimpact assessment?<\/p>\n<h2>Major environmental risks: the precautionary principle applies<\/h2>\n<p>With a project of this scale, which could involve a number of major environmental risks, the<br \/>\nCQDE reiterates the importance of favouring the precautionary principle, which aims to<br \/>\nensure that measures are taken to avoid the risk of damage even when deleterious<br \/>\noutcomes are uncertain. On the site where the plant is to be built, 52 hectares of wetlands<br \/>\nof interest, 70 hectares of agricultural land, and 140 species of birds, some of precarious<br \/>\nstatus, have been identified and could be directly threatened by the project.<\/p>\n<p>&#8220;While this would be the largest private manufacturing investment in Quebec&#8217;s history, the<br \/>\nprecautionary principle should be applied, particularly to a new industry with which we have<br \/>\nlittle experience,&#8221; explains Camille Cloutier, a lawyer with the CQDE.<\/p>\n<h2>Public concerns: the need for informed discussion and a societal choice<\/h2>\n<p>In view of the social acceptability issues at stake, the CQDE strongly recommends that the<br \/>\ngovernment not dispense with the BAPE, an essential tool to enable discussion, public<br \/>\nparticipation, and expert response, and thus ensure in-depth reflection on the impacts of<br \/>\nsuch a project.<\/p>\n<p>&#8220;Quebecers should benefit from greater transparency on the ins and outs of this project<br \/>\nand its impacts on the environment, the territory, and our communities. We need to make a<br \/>\nsocietal choice, and the public must take part in the discussion,&#8221; asserts Caroline Poussier,<br \/>\ninterim executive director of the CQDE.<\/p>\n<p>&#8220;The important work of the BAPE, which has established its credibility and independence<br \/>\nover the past 45 years, would make it possible to gather data and involve the public,<br \/>\nelements that
